Modification of a Spanish Residence Permit (Modificación)
Recurso de reposición y recurso de alzada
A modification (modificación), often called a change of status, replaces the legal basis of a residence permit without leaving Spain: studies to work, the non-lucrative permit, arraigo or a Ley 14/2013 permit to a general regime permit, the EU regime to the general one. It is a separate procedure under RD 1155/2024 (arts. 190 to 192), with its own requirements, form EX-26 and deadlines. A move into a Ley 14/2013 category is not a modification: it is a new in-country application to the UGE-CE.

How modificación differs from renewal
A renewal (renovación) keeps the legal basis of the permit for a new period. A modification changes the basis itself: studies become work, a no-work permit becomes a work permit, a Ley 14/2013 permit or an EU regime family card becomes a general regime authorization. The procedure is governed by arts. 190 to 192 of RD 1155/2024.
Renewal and modification have different requirements and forms. A renewal filed where a modification was due ends in refusal. Your years of residence do not reset on a modification: they keep accruing toward long-term residency and citizenship.
Modification routes
A modification is any move into the general regime without leaving Spain: from studies to work after finishing a program, from Ley 14/2013 permits (digital nomad, entrepreneur (startup), highly qualified professional, ICT, researcher) to a general regime work permit, from the non-lucrative permit to a work permit, and from the EU regime to the general regime when the family situation changes. Arraigo holders form a separate branch with two paths rather than one: a one-year permit under arraigo social, sociolaboral or segunda oportunidad is extended for a year under article 132.2 of RD 1155/2024 if the holder is actively seeking work and registered with the public employment service (or has a justified reason, such as illness or retirement age), and after a year of legal residence the switch to an ordinary work permit under article 191.3, for four years at once, is open as well. Since April 16, 2026 the two procedures cannot run in parallel.
Applications on the article 191 routes are filed on form EX-26 with the provincial immigration office, online through Mercurio or in person. The competent body is the Delegación or Subdelegación del Gobierno of the province where the applicant actually lives (art. 193.2 of RD 1155/2024). Either the employer or the resident may file (art. 191.5). The decision is due within three months and silence means refusal (Hoja informativa 55). Filing on time keeps the stay legal until the decision. The term of the new permit and its start date are set out below, together with the TIE step.
The transition matrix by provision. The authority determines the form, the deadline and the type of silence: the immigration office has three months and negative silence, the UGE-CE twenty days and positive silence. The UGE-CE rows are not modifications but new in-country applications to the UGE, covered in the section below.

Student to work: the graduate route
The strongest route in the current regulation. Having successfully completed the program, a graduate applies for a residence and work permit with no visa and no exit from Spain: as an employee, as an autónomo, as a highly qualified professional under Ley 14/2013, or for a job search period. The new permit is issued for 1 year and has the effects of a renewed permit of its type (article 190.9 RD 1155/2024): no restriction on activity or territory. The next renewal is for 4 years.
The filing window is 2 months before the study authorization expires and up to 3 months after it expires or after the qualification is obtained. From the moment the application is admitted for processing, a provisional residence and work authorization applies (article 190.7): you can start working without waiting for the decision. The RD 316/2026 amendment, in force since April 16, 2026, removed the coverage gap between the expiry of the study authorization and the admission of the application.
Two limitations. First, the route is closed to graduates funded by public scholarships under cooperation and development programs of their country or the EU. Second, under the new regulation the modification is available after completing the specific training for which the permit was issued. For those whose study permit was granted under the old regulation, the transitional rules of Instrucciones SEM 3/2025 preserve more lenient conditions.
From a digital nomad or startup permit to a general regime permit
Ley 14/2013 permits authorize work, so after one year of residence art. 191.3 of RD 1155/2024 applies: you only need to meet the renewal-level requirements of a work permit, with no labor market test, and the new permit is issued for 4 years at once, with no restriction on employer, activity or territory. The family switches too: family members’ Ley 14/2013 permits also authorize work, and each adult obtains their own 4 year card under the same article.
The route is covered on a dedicated page, modification of a Ley 14/2013 permit to a general regime permit: when to switch, what happens to the family’s cards, what happens to the Beckham regime and which alternatives exist within Ley 14/2013.
If your Ley 14/2013 permit has already expired or been annulled, rather than simply nearing expiry, art. 191.3 does not apply: it requires a valid permit on the filing date. In that case the way back to legal status usually runs through arraigo: arraigo de segunda oportunidad, if no more than 2 years have passed since you lost status and the reason was not fraud or a public-order issue, or arraigo social, which does not depend on your legal-status history at all.
Non-lucrative to a work permit
Before one year of residence the switch is open only to employment (art. 191.2 RD 1155/2024, Hoja 55 bis, form EX-26). Every requirement of an initial permit applies, including the labor market test: a job on the shortage occupation list or an employment service report on recruitment difficulty. The decision is due within 3 months, and silence means refusal. After a year (art. 191.4) there is no labor market test, and the self-employment route opens. The other requirements are those of an ordinary work permit: a signed contract guaranteeing activity for the duration of the authorization, an employer with no tax or social security debts and with the resources to sustain the contract, and qualifications matching the position. On the self-employment route: a viable business plan, investment and funds.
The resulting permit counts as initial: it runs for 1 year, but the following renewal is already for 4 years, and the 183 day rule of the non-lucrative permit no longer applies to a work permit. A part-time contract whose salary falls short of a sufficient annual level leads to refusal. The second standard failure: filing before the first year is complete while counting on the art. 191.4 conditions. Before a year art. 191.2 applies, and without a shortage occupation or an employment service report the application fails.
For those working remotely for a foreign employer while on the non-lucrative permit there is one way out of the gray zone: a general-regime work permit, employment only under article 191.2 before a year, or under article 191.4 after a year. A move to the digital nomad permit from the non-lucrative permit is closed by the UGE’s own guidance (teleworker FAQ, question 12): this permit does not authorize work, so previous remote work cannot be relied on, and that work itself is an infringement under Title III of LO 4/2000. Applying for the nomad permit in this situation does not solve the problem, it documents it.
From the EU regime to the general regime
The familiar de comunitario card depends on the link to an EU citizen. Divorce, termination of a registered partnership, the EU citizen’s death or departure from Spain raise the question: retain the right within the EU regime (possible under certain conditions, for instance a marriage of sufficient duration) or move to the general regime on a residence and work permit of your own.
The provision for the move into the general regime is art. 191.8: from the EU family card to a non-lucrative permit on your own means, or to a residence and work permit on a contract or an activity. The resulting permit then lives under the ordinary renewal rules. While the old card is still valid there are more options: keeping the right under the EU regime and moving to the general regime are assessed together, not after the card has expired.
Arraigo and the extraordinary regularization: after a year
Permits under arraigo social, sociolaboral and segunda oportunidad, and the extraordinary regularization permit, authorize work, so after a year art. 191.3 opens: the general regime for four years, renewal-level requirements, no labor market test. For the regularization the order is set by DA 21ª para. 10: the main path is a modification under art. 191 filed two months before the one-year card ends, the fallback is a one-year extension on job search or on a report of integration efforts. Illness or retirement age gives an extension of four years at once.
Ordinary arraigo has the same fallback under art. 132.2: a one-year extension on active job search and registration with the public employment service. Running the modification and the extension in parallel has not been possible since April 16, 2026.
From a dependent card to an independent one
A reunified spouse or partner obtains an independent residence and work permit under art. 69 of RD 1155/2024, a family member of a Spanish citizen under art. 99. Both procedures run through the immigration office and require a basis of your own: a contract, self-employed activity or means. The reunified card already authorizes work, and the independent card removes the dependence on the sponsor: divorce, death or the sponsor losing status no longer affect it.
Temporary protection: from within Spain, no visa
Beneficiaries of temporary protection apply for other permits without leaving Spain and without a visa: a general-regime work permit under art. 191, Ley 14/2013 categories, arraigo, family grounds, a permit for a child. The basis is DA 19ª of RD 1155/2024 as amended by RD 316/2026 and Instrucción SEM 2/2026 of June 22, 2026. Art. 191.7 b) bars modification from permits under art. 128.1 b), which covers temporary protection. Instrucción SEM 2/2026 (first instruction) lifts that bar for beneficiaries: DA 19ª, as the specific rule, prevails over art. 191.7. Time under protection counts toward the two years for arraigo and the five years for national long-term residence. Filing is possible while still under protection, and the protection itself has been extended by the EU Council to March 4, 2028.
Golden visa and applicants for international protection
New golden visas are no longer issued, and existing investor permits run to the end of their term. The exits are open: the general regime under art. 191.3, digital nomad and highly qualified professional under art. 76.1 of Ley 14/2013.
An applicant for international protection whose claim is still pending has no modification available. Art. 191.1 opens a modification only to those in Spain on temporary residence, and an applicant holds no residence permit, only the applicant’s document. Art. 126 closes arraigo until the final decision on protection. What remains open is the card of a family member of a Spanish citizen and the EU family card under RD 240/2007.
Common modification mistakes
Confusing renewal with modification. Filing the wrong procedure costs months and risks falling out of the filing window.
Filing with an unsuitable contract. Part-time work with an insufficient annual salary, a company with social security arrears, or a mismatch between the position and your qualifications.
Graduates waiting too long. The window closes three months after graduation. Missing it means losing the visa-free route.
Starting work before the application is admitted. The provisional authorization under article 190.7 runs from the admisión a trámite, not from the moment the application is sent.
Not checking the scholarship history. A public scholarship under a development program closes the student route, and that is established before filing.
Not a modification: moving into Ley 14/2013
A move into a Ley 14/2013 category (digital nomad, entrepreneur, highly qualified professional, ICT, researcher), from the general regime or from another category of the same law, is a new application to the UGE-CE filed from within Spain (arts. 61.1 and 76.1 of Ley 14/2013). Form EX-26 and the provincial immigration office play no part in it. There is no one-year threshold either: you can file at any time, provided the requirements of your current permit are still met on the filing date (UGE FAQ on international teleworkers, question 18). The decision is due in twenty days and silence is positive.
The same path is open from outside the law. The non-lucrative permit moves to highly qualified professional or entrepreneur under arts. 61.1 and 76.1, the student moves to digital nomad under art. 74 quinquies.1 (UGE FAQ, question 13), and to highly qualified professional or entrepreneur under art. 76.1. For a student with a job offer or remote work this is the shortest route: no degree needed and no three-month window under art. 190.
There is one exception. The graduate permit for job search or launching a business project (DA 17ª of Ley 14/2013) is filed as a modification with the provincial immigration office on form EX-26 (Hoja 20), with a decision in twenty days and positive silence.
The non-lucrative permit cannot move to digital nomad (UGE FAQ, question 12): that permit does not authorize work, so remote work before filing cannot be shown.
Term of the new permit and its start date
Both are set by article 191 of RD 1155/2024 and depend on two facts: whether a year of residence has been completed, and whether the previous permit authorized work.
| Previous permit | Year of residence | Provision | Term of the new permit | Runs from |
|---|---|---|---|---|
| Any temporary permit | no | art. 191.2 | 1 year, treated as initial | the ordinary rules for an initial permit |
| Authorized work | yes | art. 191.3 | 4 years | the day after the previous card expired, if it already has, otherwise the date of grant |
| Did not authorize work | yes | art. 191.4 | 1 year, treated as initial | the day after the previous card expired, if it already has, otherwise registration with Social Security |
Ley 14/2013 permits, arraigo and the extraordinary regularization permit authorized work: after a year they follow art. 191.3. The non-lucrative permit did not, and follows art. 191.4.
The start-date rule produces a calculation that appears in none of the ministry sheets. A decision issued after the previous card expired takes effect retroactively: residence for long-term status is not interrupted, but the four years count from the day after the card expired rather than from the day of grant. The waiting months come out of the new card. A decision issued before the previous card expired runs from the date of grant, and the wait costs nothing. Filing at the start of the window yields a longer card than filing at the end.
The three-month statutory deadline is not always met. In a decision known to us from the Subdelegación del Gobierno in Barcelona, on a modification from Ley 14/2013 to the general regime, the application was filed on February 12, 2026 and decided on September 10, 2026, seven months instead of three. The previous card expired on June 1, 2026 and the new permit runs from June 2, 2026 to June 1, 2030: four years from the start date, as art. 191.3 provides. Three months of the new card had passed before the decision arrived. The permit itself came without limits: employed or self-employed work, anywhere in Spain, in any occupation or sector.
The TIE card after the decision
A permit of more than six months carries the obligation to obtain the foreigner identity card. Under art. 209.1 of RD 1155/2024 the TIE is requested in person within one month of the permit being granted or taking effect, and for employed work with reference to registration with Social Security. Immigration office decisions repeat the condition verbatim: one month from notification, provided the permit still has more than six months to run.
Three sources name different starting points for the same month. The regulation counts from grant or entry into force, Hoja informativa 55 from Social Security registration, the decision from notification. It is one deadline: for employed work registration and entry into force coincide, and notification of the decision precedes both. The count runs from the earliest event that has occurred.
Frequently asked questions
Can a student switch to a work permit without leaving Spain?
Yes. After completing your studies, article 190 moves you to a residence and work permit with no visa and no exit from Spain. It runs for 1 year with the rights of a renewed permit (article 190.9), the next renewal for 4 years, employment and self-employment allowed. Exception: graduates on public cooperation and development scholarships.
Link to this answerWhen can you switch from the non-lucrative permit to a work permit?
Before one year of residence, only to employment, under art. 191.2 RD 1155/2024: every requirement of an initial permit applies, including the labor market test. After a year, art. 191.4 drops the labor market test and opens self-employment. Either way the permit counts as initial and runs 1 year, with the next renewal for 4 years.
Link to this answerCan you work while the modification application is pending?
Graduates can: from the moment the application is admitted for processing, article 190.7 grants a provisional residence and work authorization, full-time employment or self-employment depending on the type requested. It lasts until the decision and lapses automatically if the application is refused. On other routes you keep the rights of your previous permit.
Link to this answerWhat happens if your card expires while the application is pending?
Filing within the window extends your previous authorization until the decision is notified, so you stay legal throughout. For graduates, the RD 316/2026 amendment, in force since April 16, 2026, also closed the technical gap between expiry of the study authorization and admission of the application. That protection applies only to a filing within the window.
Link to this answerFrom what date does the new permit run after a modification?
Under art. 191.3 of RD 1155/2024 it runs from the day after the previous card expired, if that happened before the decision, and otherwise from the date of grant. The four years count from that date. A decision issued seven months after filing takes the waiting months out of the new card, while residence for long-term status is not interrupted.
