When to file for renewal

No sign-up, no data collection, everything is worked out right in your browser.

The filing window runs from the expiry date of the authorisation, and there are two regimes. Permits under Law 14/2013 (nomad, entrepreneur, PAC, researcher, ICT) count it in calendar days: 60 before expiry and 90 after. The general regime under RD 1155/2024 counts in months: two before and three after. The gap reaches a week, and the figure from one article gets carried over to the other all the time. Enter the date from the resolution and the table shows both dates for each regime, with a link to the rule.

What this does and does not do. Only the dates set by the rule. Whether you meet the renewal conditions is not something it knows. We send no reminders and ask for no email to do so: the date stays in your browser. And late filing is a lawful option, not a second deadline: the administration may open a penalty procedure alongside it.

The only regime where the window is set in calendar days rather than months: 60 days before expiry and 90 after. Clarified on 15 September 2026, and the two halves of the window carry different weight. **The 90-day tail after expiry is in the act itself**, art. 76.3, and applies to the whole of section 2. **The sixty days before expiry are also in the act, but only for HQP**: art. 71.3 reads «Durante los sesenta días anteriores al fin de la vigencia de la autorización de residencia se podrá solicitar su renovación por dos años si se mantienen los requisitos que generaron el derecho». For the digital nomad (art. 74 quinquies.3), the ICT (art. 73) and the other statuses of the section the act sets no window before expiry at all, and there the only source is the UGE document of February 2018. That document is old and parts of it are out of date (the investor route was repealed and its blanket "two years" clashes with criterion DGGM 2/2025), but the filing window has not changed and is repeated in UGE practice.

Filing within the window extends the previous permit until the decision. A late filing within three months of expiry also extends it, but the administration may open a penalty procedure under art. 52.b of Organic Law 4/2000.

Family reunification 2 months before expiry, 3 months after enter a date enter a date enter a date RD 1155/2024, art. 71.1 checked 06/09/2026

The article states both periods in one sentence, two months before and three after, with the same penalty caveat. Unlike articles 64 and 80, it does not expressly say that the previous permit stays valid while the file is decided.

Employed work (cuenta ajena) 2 months before expiry, 3 months after enter a date enter a date enter a date RD 1155/2024, art. 80.1 checked 06/09/2026

The wording matches article 64: filing in the window extends the previous permit until the decision, and so does a late filing within three months, at the risk of a penalty procedure.

Self-employment (cuenta propia) 2 months before expiry, 3 months after enter a date enter a date enter a date RD 1155/2024, art. 86.1 checked 06/09/2026
?

The same wording as for employed work. This is the general regime, not Law 14/2013: the start-up entrepreneur permit has a different window, 60 and 90 days.

Arraigo and other exceptional circumstances 2 months before expiry, 3 months after enter a date enter a date enter a date RD 1155/2024, art. 132.3 checked 06/09/2026

This is the extension of the exceptional-circumstances permit itself. Permits under this chapter run for one year, except arraigo familiar, which runs for five.

Studies (estancia por estudios), extension 2 months before expiry, 3 months after enter a date enter a date enter a date RD 1155/2024, art. 55.3 y 55.4 checked 08/09/2026

The extension is requested within two months before the visa or permit expires, a timely filing keeps the previous one valid until the decision, and a late filing within three months after also does, at the risk of a penalty procedure under art. 52.b of Organic Law 4/2000. Applies to higher and post-compulsory secondary education, volunteering and training (art. 52.1 a, b, d, e). Pupil mobility programmes (art. 52.1 c) are not extended.

Family of a Spanish citizen, if the card was issued for less than five years 2 months before expiry, 3 months after enter a date enter a date enter a date RD 1155/2024, art. 95.3 y 95.4 checked 08/09/2026
?

The permit runs five years, or the shorter period the Spanish relative intends to stay in Spain. Renewal exists only for that second case: two months before expiry or three after with a penalty procedure, and a timely filing keeps the previous permit valid. After the full five years the next station is long-term residence, not a renewal.

Family of an EU citizen: permanent card after five years 1 months before expiry, 3 months after enter a date enter a date enter a date RD 240/2007, art. 8.5, 11.1 y 13 checked 08/09/2026

The family member card is valid for five years (art. 8.5). At the end one applies not for a renewal but for the permanent card: in the month before the card expires or within three months after, with an administrative penalty (art. 11.1), after which it is renewed automatically every ten years. Renewing the five-year card itself before the permanent right accrues is allowed (art. 13) without a stated window. The rule says nothing about the old card staying valid while the file is decided: the right of residence in this regime does not depend on the card.

Months run from date to date under art. 5.1 of the Civil Code: if the closing month has no such day, the period ends on the last day of that month.

What this does and does not do

Only the dates set by the rule. It does not know whether you meet the renewal conditions, does not check your documents, and will not remind you of anything: we do not send reminders and do not ask for an email to do so. Late filing is a lawful option, not a second deadline: the administration may open a penalty procedure under art. 52.b of Organic Law 4/2000 at the same time.

What is not here, and why

  • Long-term residence and citizenship: those are new procedures with their own deadlines, not renewals.
  • Public holidays and weekends: if the last day of a period is not a working day it moves to the next one (art. 30.5 of Law 39/2015). The holiday calendar differs by province and we do not track it.
  • Permits whose window is not set in the rules: see the guide for that permit.
  • Swapping a visa for a residence card: for the nomad that is a separate 60-day deadline before the visa expires, and it is not a renewal.
